Sex offender registration under the Crimes (Child Sex Offenders) Act 2005 (ACT) is a relevant consideration under s 17(4) of the Crimes (Sentencing) Act 2005 (ACT) when deciding whether to record a conviction. For young offenders, s 133C permits the court to give greater weight to rehabilitation than to punishment and deterrence, even for serious sexual offences against children. The Crown cannot on appeal contend that a consideration was irrelevant when it told the sentencing judge at first instance that it was something he should consider.
