Section 21AW(2) of the Evidence Act 1977 (Qld) requires a direct, composite instruction to the jury covering all three limbs — including that no inference as to guilt should be drawn from the use of special measures — and this requirement cannot be satisfied indirectly through other orthodox directions such as the presumption of innocence or the standard of proof. Non-compliance in an uncorroborated 'word against word' case will result in the convictions being set aside without application of the proviso. A trial judge's summary of prosecution submissions on the complainant's motivation to lie does not constitute misdirection where the summing up, read as a whole, does not shift any onus to the accused.
