The rehabilitation of youthful offenders must yield to deterrence, denunciation and community protection in cases of gratuitously violent offending in public places, particularly where the offender has previously been afforded opportunities to rehabilitate through community-based orders. The seriousness of an offence of violence is not diminished by the victim's subsequent recovery where that recovery was attributable to medical intervention and good fortune. For parity purposes, the relevant comparison between a sentence of imprisonment and a Youth Justice Centre order is between the head sentences, not between the non-parole period and the Youth Justice Centre term.
