Where an offender knows or suspects that a child victim is pregnant as a result of prior sexual offending and commits a further sexual offence, that knowledge seriously aggravates the moral culpability and objective criminality of the further offence. Social deprivation and intellectual deficit, while relevant to sentencing, do not diminish moral culpability or objective seriousness where there is no causal link between those circumstances and the offending. A discount of 20 per cent for a guilty plea entered on the day of trial may be appropriate where the plea was the culmination of ongoing discussions and the Crown does not oppose the discount.
