The parity principle does not require identical non-parole period differentials to head sentence differentials between co-offenders; the proportional relationship between head sentence and non-parole period may legitimately differ where co-offenders have different criminal histories, ages, and prior compliance with court orders. Section 5(2)(e) of the Sentencing Act 1991 (Vic) is concerned with communication of an intention to plead guilty in the proceeding, not private instructions to legal representatives.
