A gross breach of trust by an employee who exploits skills and techniques imparted by the employer is capable of justifying a custodial sentence for one co-offender where the other co-offender, who did not occupy a position of trust, receives a non-custodial disposition. General deterrence plays an even more important role in breach of trust cases. The Guideline Judgment in Boulton does not preclude a term of imprisonment combined with a CCO in cases involving breach of trust and sophisticated fraud.
