The 'show cause' inquiry under s 16A(1) of the Bail Act 2013 (NSW) is a separate question from the assessment of unacceptable risks under s 18, though there is often substantial overlap in the relevant factors. Cause may be shown by a single powerful factor or a powerful combination of factors, but the applicant need not show special or exceptional circumstances. Bail decisions of single Supreme Court judges have little or no precedential value unless they contain a discussion of legal principles. The strength of the Crown case that an applicant committed a serious offence against public justice whilst on bail for a similar offence is a significant factor weighing against a finding that cause has been shown.
