An application for a statutory order of review under the Judicial Review Act 1991 (Qld) must be filed in the Trial Division, not the Court of Appeal. There is no presumption that a statutory conferral of jurisdiction upon 'the court' or 'the Supreme Court' confers jurisdiction upon the Court of Appeal. A single judge of appeal may strike out an application improperly instituted in the Court of Appeal.
