Where the application of s 10C to a notional non-parole period (fixed without reference to a guilty plea) would result in a period substantially less than 20 years, special reasons generally exist under s 32A(2)(b) to fix a non-parole period below the mandatory minimum for murder. However, the statutory minimum constrains the extent of the s 10C reduction, and a finding of special reasons will not generally support reducing the period to the full extent of the applicable percentage. The meaning of 'objective seriousness' in s 32A(1) extends beyond the actus reus to include motive, mental element, and surrounding circumstances of the offence.
