An applicant seeking reinstatement of a deemed-abandoned application for leave to appeal under r 64.45(4)(a) of the Supreme Court (General Civil Procedure) Rules 2015 (Vic) need not demonstrate real prospects of success on appeal; the application should be reinstated unless the failure of the proposed appeal is 'plainly demonstrable'. The power to reinstate extends to abandonment under both r 64.45(1) and r 64.45(2). However, repeated non-compliance will exhaust the Court's indulgence.
