A depressive illness that has stabilised and can be managed by custodial health services does not, without more, satisfy the show cause requirement under s 16A of the Bail Act 2013, particularly where the Crown case is very strong and the offences carry maximum penalties of life imprisonment. The applicant must demonstrate that their mental health condition sets them apart from other similarly placed individuals in custody.
