Section 47 restrictions on commencement dates for consecutive sentences do not apply to aggregate sentences under s 53A, giving sentencing judges greater flexibility in adjusting the statutory ratio. When an offence is dealt with on a s 166 certificate, the indicative sentence must not exceed the Local Court jurisdictional maximum (2 years under s 268), and failure to observe this limit may demonstrate that the sentencing discretion miscarried. An appellate court resentencing is not bound to impose an aggregate sentence merely because the sentencing judge did so.
