An applicant for leave to appeal from the QCAT Appeal Tribunal under s 150 must demonstrate not merely an error of law but that the error is material and gives rise to a consequence beyond an asserted erroneous outcome — in particular, that the resulting order was wrong or that substantial injustice was suffered. Where the Appeal Tribunal grants leave on questions of mixed law and fact, it correctly proceeds to a rehearing of the entire matter and is not required to first consider questions of law separately or to remit. Interest on unliquidated damages under reg 34B of the QBCC Regulation 2003 runs from the date the amount is fixed by assessment, not from the date the cause of action arose.
