A court cannot make a home detention order under s 33BB of the Criminal Law (Sentencing) Act 1988 (SA) in respect of a sentence whose prior suspension has been revoked under s 58, because a home detention order is itself a form of suspension and s 58 precludes re-suspension. Section 58(4) exhaustively covers the ameliorative options available upon revocation. Progress towards rehabilitation while subject to a suspended sentence bond does not, of itself, constitute 'special circumstances' under s 58(4).
