Where co-offenders are sentenced for aggravated burglary and one co-offender possessed a firearm, the firearm cannot be treated as an aggravating factor for the other co-offender unless the sentencing judge is satisfied beyond reasonable doubt that the other co-offender knew of the weapon. The existence of a carefully orchestrated joint criminal enterprise is not, on its own, sufficient to justify such a finding. However, such an error may not lead to resentencing where the objective gravity of the offence and the offender's criminal history would warrant the same sentence regardless.
