The utilitarian value of a guilty plea under s 35 of the Crimes (Sentencing) Act 2005 (ACT) is concerned with the timing of the plea and the related benefit to the justice system, and must not be conflated with the consideration of sparing the victim from trial, which is primarily relevant to remorse. A guilty plea entered one week before trial will usually attract a discount of at least 10%. The standard range for a guilty plea entered in the Supreme Court is 10-15%.
