Where two charged acts occur within the same uninterrupted episode and the evidence for both comes from the same witness giving a consistent account, a guilty verdict on one and not guilty on the other will be an affront to logic and common sense unless there is a logical basis in the evidence to distinguish the complainant's credibility between the two counts. Where inconsistent verdicts on one count may have infected deliberations on other counts, all guilty verdicts should be set aside.
