Comparable sentencing decisions such as the analysis in R v Feakes may be used as a yardstick for guidance in sentencing for drug trafficking offences, but may not be treated as establishing a pre-determined range with fixed boundaries requiring extraordinary circumstances for departure. A sentencing judge who starts from a fixed minimum and asks whether extraordinary circumstances justify departure has erred in principle, even if the resulting sentence is otherwise appropriate.
