Business practice evidence remains admissible to prove the fraud element of charges of procuring sexual penetration by fraud even after guilty pleas to related deception charges, as the fraud element must still be proved for the penetrative charges. The Verdins principles do not apply to personality disorders as distinct from mental illness, following O'Neill. A sentencing judge's expression of dissatisfaction with a maximum penalty does not, without more, establish double punishment or illegitimate sentencing.
