In a case of a single count of penile penetration (whether vaginal or anal) where there is a plea of not guilty, a term of imprisonment of 5 to 6 years would not be unusual, though sentences outside that range may be justified by the circumstances. There is no hierarchy of sexual penetration. An offender's borderline intelligence and executive dysfunction, while not causative of the offending, may reduce moral culpability and the significance of general deterrence, but do not diminish the importance of personal deterrence and protection of vulnerable persons where the offender maintains denial and shows no remorse.
