The behaviour of a sexual assault complainant during and after an assault — including failing to call out, apologising to the perpetrator's partner, and falling back asleep — is not necessarily indicative of implausibility or inconsistency with an allegation of sexual assault. A Crown submission inviting the jury to assess the plausibility of the defence version by reference to the complainant's observed demeanour and character does not reverse the onus of proof.
