COVID-19 lockdown restrictions on prison conditions — including reduced time out of cell, cessation of contact visits, and prisoner apprehension of vulnerability to infection — are relevant matters to be taken into account on sentencing. Where an offender's schizoaffective disorder significantly contributed to the offending by rendering the offender unable to think clearly or inhibit impulses, moral culpability is significantly reduced and the sentencing purposes of general and specific deterrence are materially moderated. An offender who made offers to plead guilty that were rejected by the prosecution is entitled to have the utilitarian value of those offers taken into account as a mitigating factor on resentencing, though the weight of remorse may be diminished by inconsistent evidence given at trial.
