Where a sentencing judge's starting point for an offender who pleaded guilty is identical to the head sentence imposed on a co-offender after trial, and the first offender has multiple differentiating subjective factors in their favour (lesser involvement, extra-curial punishment, remorse, favourable rehabilitation prospects), a justifiable sense of grievance is established warranting appellate intervention on parity grounds. Physical injuries sustained during the commission of an offence may constitute extra-curial punishment even where they arise from the offender's own criminal conduct, provided they were accidentally rather than deliberately inflicted.
