A sentencing judge's failure to expressly refer to an offender's lack of prior criminal convictions and good character does not necessarily establish error, particularly in complex multi-offender sentencing exercises where the judge's overall findings (such as a finding of special circumstances based on a strong subjective case) implicitly encompass those matters. Prior good character carries less weight as a mitigating factor in drug supply and importation offences.
