A sentencing judge who effectively sentences for a different and more serious offence than that charged commits appealable error. Sentences of 50 per cent of the maximum for summary offences following guilty pleas require justification, particularly where the offending is not a serious example of the offence. A discount of at least one-third for significant assistance to authorities (including ongoing cooperation placing the offender at risk) may be appropriate in large commercial drug trafficking cases.
