Section 160F(2) of the Penalties and Sentences Act 1992 (Qld) is a mechanical provision that does not regulate the substance of a sentence or prescribe sentencing methodology; a sentencing judge does not err by calculating a parole eligibility date by reference to the one-third mark of the sentence imposed rather than the total period of imprisonment. Where offending is committed while on parole for similar offending, the hypothetical single sentencing exercise is not appropriate; the sentencing judge must instead ensure the combination of sentences is just and appropriate but not crushing.
