A former director of a company in liquidation who wishes to pursue an appeal on behalf of the company must obtain court approval under s 198G(3)(b) of the Corporations Act 2001 (Cth); objecting to dismissal for want of prosecution without having obtained such approval is insufficient. The Court of Appeal will dismiss dormant applications for leave to appeal on its own motion where no substantive steps have been taken for an extended period and no party intends to continue.
