The characterisation of a scheme as a pyramid scheme under s 45(1) ACL is determined objectively by the scheme's features, not by what individual participants understood about the scheme. Service of affidavits disclosing the substance of the evidence may weigh heavily in favour of dispensing with formal tendency notice requirements in civil proceedings where tendency evidence is adduced.
