When uncharged acts of domestic violence are admitted as relationship evidence under s 103CB of the Evidence Act 1977 (Qld) and relied upon for both context and propensity, the trial judge's direction need not expressly state that propensity can be used to assess the complainant's credibility, provided this is implicit and clear from the direction as a whole. The Pfennig similar fact evidence test does not apply to such relationship evidence. The court identified eight matters that should be covered in such a direction, providing a practical template for trial judges.
