The residual discretion on a Crown sentence appeal may be exercised to dismiss the appeal despite manifest inadequacy where the total effective sentence, after cumulation on related charges, is substantially closer to the appropriate range, particularly where the offender is young, cooperative, and the enterprise was unsophisticated. An indictable offence triable summarily cannot be brought before the County Court by transfer from the Magistrates' Court; it requires committal or direct indictment, and a conviction entered without proper jurisdiction is a nullity.
