A police officer's questions asked in the first moments of arriving at a volatile crime scene, directed at ensuring public safety (locating weapons, identifying number of offenders), do not constitute 'questioning' for the purpose of s 139(5) of the Evidence Act 2008, even if the questions elicit admissions, and no caution is required before such questions are asked.
