23 Secondment
ACTEW may, on any terms agreed between it and another joint venture entity, second to the entity, for the purposes of the joint venture, the services of any of its employees.
ACTEW may, subject to any agreement with the relevant joint venture entity, terminate at any time the secondment of an employee or a class of employees.
A provision in an agreement is void so far as—
it is inconsistent with subsection (2) or a right or remedy arising from the subsection; or
it would make it unduly impractical or disadvantageous for ACTEW to exercise its power under subsection (2).
Subsection (2) applies even if the proper law of the agreement is that of another jurisdiction.
Nothing in subsection (2) affects the operation of an agreement so far as it can operate consistently with that subsection.
