88 Direction to give information about potential notice recipients
This section applies to a corporation to whom an improvement or prohibition notice is given.
The director-general may give the corporation a written direction to give information—
reasonably required by the director-general to determine if the corporation has any associated entities to whom a notice may be given; and
within a stated reasonable period.
A person commits an offence if the person fails to comply with a direction under subsection (2).
Maximum penalty:
for a 1st offence—100 penalty units; or
for a 2nd or subsequent offence—200 penalty units.
Subsection (3) does not apply if the person has a reasonable excuse for failing to comply with the direction.
The defendant has an evidential burden in relation to the matters mentioned in s (4) (see Criminal Code, s 58).
