The controller must not vary, or suspend or cancel a licence under section 23, unless the controller has given the licensee written notice that—
states the ground on which the controller intends to vary, suspend or cancel the licence; and
states the facts and circumstances that, in the controller’s opinion, constitute that ground; and
informs the licensee that the licensee may, within 28 days after the date of the notice, give to the controller a written response to the matters stated in the notice.
For the purpose of deciding whether to exercise the controller’s functions under section 22 or 23, the controller must have regard to any response given in accordance with a notice under subsection (1).
A provision of a law that gives an entity (including a person) a function also gives the entity powers necessary and convenient to exercise the function (see Legislation Act, s 196 and dict, pt 1, def entity).
