Community Title Act 2001

The body corporate may make by-laws about—

the administration, management and control of the common property; and

the use and enjoyment of privately owned lots and the common property.

A by-law may—

adopt with or without change the by-laws in schedule 1; or

amend or revoke a by-law.

The first by-laws of the body corporate are to be—

the by-laws lodged with the community title scheme; or

if no by-laws are lodged with the scheme—the by-laws in schedule 1.

The by-laws lodged with the scheme may include exclusive use by‑laws.

If the by-laws of a body corporate do not deal with a subject required under this Act to be dealt with in the by-laws, the body corporate is taken to have adopted the relevant by-law in schedule 1 on that subject.

The first by-laws of the body corporate come into operation on the registration of the scheme.
