Construction Occupations (Licensing) Act 2004

The director‑general may appoint a public servant as the Australian Capital Territory Construction Occupations Registrar (the registrar).

For the making of appointments (including acting appointments), see the Legislation Act, pt 19.3.

In particular, a person may be appointed for a particular provision of a law (see Legislation Act, s 7 (3)) and an appointment may be made by naming a person or nominating the occupant of a position (see Legislation Act, s 207).

However, the director‑general must not appoint a person under subsection (1) unless satisfied that the person has relevant experience or a relevant qualification in 1 or more of the following areas:

building;

building assessment;

building surveying;

draining;

electrical;

engineering;

gasfitting;

plumbing;

gas appliance work;

works assessment;

administration of building or construction industry regulatory schemes.

The appointment must not be for longer than 3 years.
