6438 Service if no-one found at party’s address for service
This rule applies to a party to a proceeding if the party does not have a solicitor, and no-one can be found at the party’s address for service.
This rule does not apply to a criminal proceeding (see r 4006 (Criminal proceedings—application of pt 6.8) and see also r 4008 (Criminal proceedings—service if no-one found at accused person’s address for service)).
Any document in the proceeding may be served on the party by leaving a copy at the party’s address for service in a position where it is reasonably likely to come to the party’s attention.
This rule does not apply to a document that is required under a territory law to be served personally on the party.
A territory law includes these rules (see Legislation Act, s 98).
