Domestic Animals Act 2000

A person may apply to the registrar—

to be registered as an assistance animal trainer; or

for a registered assistance animal trainer—to renew the assistance animal trainer’s registration.

An application must—

be in writing; and

include any information prescribed by regulation.

Within 30 days of receiving the application, the registrar must—

register the applicant for a stated period; or

register the applicant for a stated period subject to stated conditions; or

refuse to register the applicant.

Failure to register the applicant within the required time is taken to be a decision not to register the applicant (see ACT Civil and Administrative Tribunal Act 2008, s 12).

The registrar may only register the applicant if satisfied the applicant—

has the skills and experience to train an animal to meet the assistance animal standard; and

has not, within 2 years before the application was made, been convicted or found guilty of an offence under—

this Act; or

the Animal Welfare Act 1992; or

a law of a State substantially corresponding to this Act or the Animal Welfare Act 1992; and

State includes the Northern Territory (see Legislation Act, dict, pt 1).

The registrar must, as soon as practicable after deciding whether to register the applicant, give the applicant written notice of the decision under subsection (3).
