106E Assistance animal allowed in public places and premises
A person commits an offence if the person—
stops a person accompanied by an assistance animal entering or using a public place or public premises because of the animal; or
stops an assistance animal entering a public place or public premises; or
removes an assistance animal from a public place or public premises.
Maximum penalty: 50 penalty units.
Subsection (1) does not apply if the person has a reasonable excuse.
The defendant has an evidential burden in relation to the matter mentioned in s (2) (see Criminal Code, s 58).
A person commits an offence if—
a person accompanied by an accredited assistance animal (the accompanied person) shows the person evidence the animal is an accredited assistance animal; and
the person either—
stops the accompanied person entering or using a public place or public premises because of the animal; or
stops the animal entering a public place or public premises; or
removes the animal from a public place or public premises.
Maximum penalty: 50 penalty units.
A person commits an offence if the person imposes a fee or charge on the accompanied person for bringing the assistance animal onto or into a public place or public premises.
Maximum penalty: 50 penalty units.
An offence against subsection (3) or (4) is a strict liability offence.
