106F Falsely claiming animal is assistance animal
A person commits an offence if—
the person is accompanied by an animal in a public place or public premises; and
the person represents (orally or in some other way) that the animal is an assistance animal; and
the animal is not an assistance animal.
Maximum penalty: 20 penalty units.
Example—par (b) the animal is wearing assistance animal identification
A person commits an offence if—
the person is accompanied by an animal in a public place or public premises; and
the person represents (orally or in some other way) that the animal is an accredited assistance animal; and
the animal is not an accredited assistance animal.
Maximum penalty: 20 penalty units.
An offence against subsection (2) is a strict liability offence.
