318 Identification of voters and votes
Except as authorised under this Act, an officer shall not make any mark on a ballot paper that would be likely to enable the identification, directly or indirectly, of the person who votes on the ballot paper.
Maximum penalty: 50 penalty units, imprisonment for 6 months or both.
Except as authorised under this Act, an officer or a scrutineer shall not, directly or indirectly, disclose any information acquired in the exercise of their functions under this Act that would be likely to enable it to be known how an identified voter has voted.
Maximum penalty: 50 penalty units, imprisonment for 6 months or both.
In subsection (2):
officer includes a person who has been, but is no longer, an officer.
scrutineer includes a person who has been, but is no longer, a scrutineer.
