29 Suitability of activities—risk management plan
This section applies if the conservator is—
making a decision about whether an activity is a suitable activity for a fisheries licence; and
satisfied that carrying on the activity in accordance with the licence is likely to cause undue risk to people or property.
The conservator may, by written notice given to the applicant (a risk management plan notice), require the applicant to prepare a risk management plan for the licence.
The risk management plan must—
identify the risks to people and property; and
set out the procedures, practices and arrangements for eliminating or minimising the risks.
The conservator need not decide an application for a fisheries licence if—
the conservator has given the applicant a risk management plan notice; and
the applicant does not comply with the notice.
