39 Decision on application
(1)
The conservator must, on application being made under section 38—
(a)
register the applicant as a fish dealer; or
(b)
refuse to register the applicant.
(2)
In deciding whether to register an applicant, the conservator must consider whether the applicant has been convicted, or found guilty, of an offence against this Act or a law of a State corresponding to this Act.
(3)
Subsection (2) does not limit the matters the conservator may consider in deciding whether to register an applicant.
