Exempt conduct—pt 8

In force

For an offence under this part, a person’s conduct is exempt conduct if—

(a)

the person’s conduct is undertaken in accordance with 1 of the following:

(i)

a fisheries licence;

(ii)

a fisheries management plan;

(iii)

a cultural resource management plan;

(iv)

a native species conservation plan; or

(b)

the person is an authorised person exercising a function under this Act.

Note The defendant has an evidential burden in relation to the matters mentioned in this section (see Criminal Code, s 58).
