25 Compliance indicators to be attached
A trader commits an offence if—
the trader sells a gas appliance; and
the gas appliance—
does not have a compliance indicator attached to it; or
has a compliance indicator attached to it that is not in accordance with the regulations.
Maximum penalty: 50 penalty units.
Subsection (1) does not apply if—
the trader believed on reasonable grounds that the gas appliance was not capable of being used as a gas appliance; and
the sale was made on the basis that the gas appliance could not be used as a gas appliance.
Subsection (1) does not apply to—
a second-hand gas appliance; or
a gas appliance within 6 months after it becomes an approved gas appliance.
