37 Protection of officials from liability
In this section:
official means—
the housing commissioner; or
anyone else exercising a function under this Act.
An official is not personally liable for anything done or omitted to be done honestly and without recklessness—
in the exercise of a function under this Act; or
in the reasonable belief that the conduct was in the exercise of a function under this Act.
Any liability that would, apart from this section, attach to an official attaches instead to the Territory.
A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any approved housing assistance program or regulation (see Legislation Act, s 104).
