Judicial Commissions Act 1994

The Attorney-General must approve a protocol about dealing with complaints made in relation to a presidential member of the ACAT.

An approved protocol may provide for the appointment of a suitably qualified person to consider a complaint in relation to a presidential member.

An approved protocol must provide—

for the following to be told about the complaint as soon as practicable:

the subject of the complaint;

if the subject of the complaint is not the president—the president; and

for a recommendation to be made to the Executive to appoint a judicial commission to examine the complaint if the complaint could justify parliamentary consideration of the removal of the presidential member.

An approved protocol is a notifiable instrument.
