79 Enforcement of obligations

(1)

The registrar may apply to the ACAT for an order to enforce an obligation imposed under this Act.

Note A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any regulation (see Legislation Act, s 104).

(2)

The ACAT may make any order it considers appropriate in relation to—

(a)

the registration of an employer or worker; or

(b)

the keeping of, and access to, records relating to a worker; or

(c)

the recovery of any payment required to be made by an employer; or

(d)

any other matter for the purpose of enforcing an obligation under this Act.

Division 8A.1 The authority and governing board

Note The governance of territory authorities, including the Long Service Leave Authority, is regulated by the Financial Management Act 1996 (the FMA), pt 9 as well as the Act that establishes them.

The FMA, pt 9 deals, for example, with the corporate status of territory authorities and their powers, the make-up of governing boards, the responsibilities of the governing board and board members, how governing board positions can be ended, meetings of governing boards and conflicts of interest.
