Who is an employee?

In force

(1)

An individual is an employee for a covered industry if the individual—

(a)

is—

(i)

employed by an employer for the industry (whether in the ACT or elsewhere); or

(ii)

declared to be an employee for the industry under section 12; and

(b)

is not declared not to be an employee for the industry under section 13.

(2)

In this section:

employed includes employed as—

(a)

a full-time employee; or

(b)

a part-time employee; or

(c)

a casual employee; or

(d)

a person remunerated at piecework rates or completely or partly by commission; or

(e)

an apprentice.

Note For this Act, an individual declared to be an employee of a stated employer is taken to be employed by the employer (see s 12 (5)).
