173 No entitlement to death benefits—death benefits paid under workers compensation scheme

(1)

This section applies if—

(a)

a person dies as a result of a motor accident; and

(b)

death benefits (other than funeral expenses) are paid under a workers compensation scheme for the benefit of a dependant of the person.

(2)

The dependant is not entitled to death benefits in relation to the person’s death.

(3)

If the dependant has been paid death benefits under this part, the insurer is entitled to recover the death benefits from the dependant.
